By accessing or using this Website, submitting a consultation request, or engaging our medical and patient-support services, you ("you", "the patient", or "the user") agree to be bound by these Terms of Service. If you do not agree with any part of these terms, please do not use our Website or services.

1. About Our Services

UpRise provides limb lengthening surgery and related medical tourism services under the direction of Dr. Hüseyin Kavak, an orthopaedic surgeon specialising in limb lengthening and sports medicine. Our services include, but are not limited to:

• Initial online consultation and medical evaluation
• Surgical procedures including LON, Precice, and Fitbone methods
• Post-operative care, physiotherapy, and rehabilitation
• Accommodation coordination, airport transfers, and patient support during your stay in Istanbul

All surgical procedures are performed at accredited hospitals in Istanbul, Turkey. UpRise acts as the coordinating entity between the patient, the surgeon, and third-party service providers (hospitals, accommodation, transport).

3. Eligibility

Our services are intended for adults (18 years of age or older) who have completed bone growth and are in suitable overall health for elective orthopaedic surgery. By submitting a consultation request, you confirm that you meet this age requirement.

Final eligibility for surgery is determined solely by Dr. Hüseyin Kavak following a medical evaluation, which may include X-rays, blood tests, and a physical examination. UpRise reserves the right to decline a patient if the medical team determines that surgery would not be safe or appropriate.

4. Consultation & Booking Process

4.1 Online Consultation

Submitting a form on our Website initiates a free preliminary consultation. This consultation is intended to assess your general suitability and provide initial guidance. It does not create a doctor–patient relationship or constitute a commitment to proceed with surgery on either party's behalf.

4.2 Treatment Agreement

If you choose to proceed, you will receive a detailed treatment plan and a separate Treatment Agreement outlining the specific procedure, pricing, inclusions, payment schedule, and cancellation terms. Surgery will only be scheduled after the Treatment Agreement is signed by both parties and the applicable deposit has been received.

4.3 Informed Consent

Before any surgical procedure, you will be required to sign a medical informed consent form. This document will explain the procedure, potential risks, complications, alternative treatments, and expected recovery process in detail.

5. Pricing & Payment

5.1 Pricing

All prices displayed on this Website are in Euros (EUR) and are indicative. Final pricing is confirmed in your individual Treatment Agreement and may vary based on the selected method, lengthening area (femur, tibia, or both), and any additional medical requirements identified during your evaluation.

5.2 What Is Included

Surgical package inclusions (such as hospital stay, medication, transfers, and follow-up care) are specified in each Treatment Agreement. Services not explicitly listed as included — such as extended accommodation, additional physiotherapy sessions beyond the agreed programme, or travel insurance — are the patient's responsibility unless otherwise agreed in writing.

5.3 Payment Terms

Payment terms, accepted methods, deposit requirements, and instalment schedules (if applicable) are defined in your Treatment Agreement. UpRise reserves the right to postpone or cancel a scheduled procedure if payment obligations are not met by the agreed deadlines.

6. Cancellation & Refund Policy

Cancellation terms are governed by the Treatment Agreement signed between you and UpRise. As a general guideline:

• Cancellations made more than 30 days before the scheduled surgery date may be eligible for a partial or full refund of the deposit, minus administrative costs.
• Cancellations made within 30 days of the surgery date may result in forfeiture of the deposit, as medical supplies and hospital reservations may have already been arranged.
• If UpRise or the medical team cancels or postpones a procedure for medical or operational reasons, a full refund or rescheduling will be offered.

Refunds for services already rendered (completed surgery, accommodation nights used, physiotherapy sessions attended) are not available. Specific terms in your Treatment Agreement take precedence over these general guidelines.

7. Patient Responsibilities

By engaging our services, you agree to:

• Provide accurate and complete medical history, including current medications, allergies, and pre-existing conditions.
• Follow pre-operative and post-operative instructions given by Dr. Hüseyin Kavak and the medical team, including physiotherapy exercises, medication schedules, and activity restrictions.
• Attend all scheduled follow-up appointments and X-ray sessions during your stay in Istanbul.
• Arrange valid travel insurance covering medical treatment abroad, including emergency evacuation if required.
• Ensure your travel documents (passport, visa) are valid for the duration of your planned stay in Turkey.
• Inform our team promptly of any complications, unusual symptoms, or changes in your health during the treatment period.

Non-compliance with medical instructions may adversely affect your surgical outcome. UpRise cannot be held responsible for complications arising from a patient's failure to follow prescribed care protocols.

8. Risks & Limitation of Liability

8.1 Surgical Risks

Limb lengthening surgery, like any surgical procedure, carries inherent risks including but not limited to: infection, nerve or vessel damage, delayed bone healing, joint stiffness, uneven lengthening, device complications, blood clots, and the need for additional procedures. These risks will be explained in full during your informed consent process.

8.2 No Guarantee of Results

While Dr. Hüseyin Kavak and the UpRise team strive for optimal outcomes, we do not guarantee specific results, including exact height gain, recovery timeline, or cosmetic outcome. Results depend on factors including your bone biology, age, adherence to rehabilitation, and overall health.

8.3 Limitation of Liability

To the fullest extent permitted by applicable law, UpRise's total liability for any claim arising out of or related to our services shall not exceed the total amount paid by you under your Treatment Agreement. UpRise is not liable for indirect, incidental, or consequential damages, including loss of income, travel costs, or emotional distress.

8.4 Third-Party Services

UpRise coordinates with third-party providers for hospital facilities, accommodation, and transportation. While we carefully select our partners, we are not liable for the acts, omissions, or negligence of independent third-party service providers. Any disputes with third-party providers should be directed to the relevant party.

9. Intellectual Property

All content on this Website — including text, images, graphics, videos, logos, icons, and design elements — is the property of UpRise or its content suppliers and is protected by applicable copyright and trademark laws. Before initiating formal legal proceedings, both parties agree to attempt to resolve any dispute through good-faith negotiation. If a resolution cannot be reached within 30 days, either party may pursue the matter through the competent courts.
